Acceptance of the terms of use, which is deemed to be made by your navigation on the Website, implies your explicit and unreserved agreement to these terms. If a user does not agree with these terms, he must refrain from using the Website and the online store and from any transaction with it.

The Administrator reserves the right to modify the terms of use at any time and without justification, therefore visitors should regularly check their content. The modification does not affect orders that have already been completed by the customer, as regards the terms associated with these orders.

It is strictly forbidden to copy, modify, republish, reproduce or otherwise exploit any part of the content of the Website without the prior written permission of the Administrator. In any case, their appearance and display on the Website should not in any way be construed as a transfer or assignment of a license or right to use them.

INFORMATION ABOUT PRODUCTS / SERVICES PROVIDED

The Administrator is committed to the accuracy, truthfulness and completeness of the information provided in the online store and in general on the Website, both with regard to the existence of the essential characteristics described for each product it has, as well as the services and transactions provided through the online store.

The Administrator, within the framework of the principles of good faith and transactional ethics and practices, is not responsible and is not bound for errors due to an error during the registration of electronic data on the Website or for errors of third parties, which could not be detected or prevented or were inadvertently, based on the above principles, not detected.

The online store provides the content (information, names, photos, illustrations, etc.), the products and services available through the Website “as is”. However, there may be discrepancies in the characteristics of the products between appearance on the Website and printing, for which the Administrator is not bound and is not responsible. In any case, for products purchased by the user/customer in electronic file format and printed by him/her, the Administrator is not responsible for the quality of the electronic/digital appearance on the customer’s devices or the printing.

Certain products available in the store are offered as individual pendants, without a chain included. In these cases, the product refers exclusively to the pendant and is intended to be worn either with a chain provided separately by the store or with a chain already owned by the customer.

 As chains may vary in thickness, width, size, or clasp type, the store cannot guarantee compatibility of the pendant with chains that have not been purchased from us.

 The customer is responsible for ensuring that the chain they intend to use is suitable for the specific pendant and that it can pass through the pendant’s bail or opening. The store bears no responsibility if the pendant cannot be attached to or used with a chain that was not purchased from the store.

CUSTOM ORDERS

Custom orders are not eligible for refunds. The customer acknowledges and agrees that once they approve the 3D printing of the final design the order is considered final and cannot be further processed. No changes, cancellations or refunds are possible. The customer also accepts that there may be minor differences in color, size or shape due to technical characteristics of the print or different display on the screen, which do not constitute a reason for return or correction. With approval, the customer fully accepts the final design and the result of the printing & casting. Exceptions are cases where structural problems have arisen during casting that make the jewelry either fragile or impractical.

RETURNS

• We accept requests for refunds or product exchanges within 14 days from the date of receipt by the buyer. The date of receipt is recorded in the courier service's records.
• TOUCHED store assumes all return and reshipment costs for the first order for each customer. For additional returns, the customer is responsible for all costs to and from the store.
• The return package must include the proof of purchase and the original packaging.
• Products must be returned in their original condition without damage.
• The refund will be made within 10 working days from the moment we receive it, in the same way in which the order was made.
• Completing the form and submitting the proof of purchase are necessary to identify the order.
• In the event that any of the above is received, or the products are damaged, our store reserves the right to not accept the return.
• Returning products for a refund does not apply in the case of a gift.
• Products can be exchanged for products of equal or greater value. Partial refunds are not available.

LIMITATION OF LIABILITY

The Administrator, within the context of its transactions from the online store, is not responsible for any further damages that may arise from the execution or non-execution of orders, or from the delay in execution, for any reason.

The Website's online store cannot provide any guarantee for the availability of products and services, but undertakes the obligation to promptly inform customers of unavailability.

The Administrator takes every possible action towards the development, updating, maintenance and improvement of the services provided and the Website in general. All necessary organizational and security measures are taken, seeking to provide the safest possible environment for visitors. However, it is always possible that errors/malfunctions/interruptions may occur while browsing the Website and/or viruses or other harmful software (malware) may appear.

The Management Company does not guarantee the technical integrity, availability, integrity or security of the Website, while visitors are invited to take all necessary measures to protect the security and integrity of their devices.

In any case, the Administrator is not liable, civilly or criminally, for any damage that a visitor to the online store or a third party may suffer due to a cause related to the operation or non-operation, and/or the use of the website, and/or the inability to provide services, and/or products, and/or information available through it, and/or from any unauthorized interventions by third parties in products, and/or services, and/or information available through it.

Price changes are effective from the moment they are published in the online store and do not affect orders that have already been confirmed. Any discounts or promotions may also be modified or canceled without notice. In addition, any discounts or promotions cannot be applied to special (custom) orders.

FINAL PROVISIONS

Without prejudice to any specific provisions more favorable to the Administrator or mandatory law, any liability of the Administrator is limited to acts or omissions caused by intent or gross negligence.
